We take your privacy seriously, and we want you to know what happens with the data we collect about you. The use of “OutMatch”, “we”, “us”, or “our” within this Statement are all references to OutMatch, Inc. and its relevant affiliates and subsidiaries. Please read this Platform Privacy Statement carefully, as it sets out important information relating to how we handle your personal information.
This Platform Privacy Statement does not apply to any information or data collected by OutMatch for purposes such marketing, advertising, managing Customer relationships, or direct employment with OutMatch. Details can be found in our Website Privacy Statement.
- What does this Statement Cover?
OutMatch provides Talent Selection, Development and Enablement technology and services (collectively, the “Platform”) to employers, and to our distributors and resellers (collectively, our “Customers”) to bring clarity and insight to their talent decisions and initiatives. This Privacy Statement covers the privacy practices OutMatch employs when OutMatch Customers use, distribute, or resell the OutMatch Platform as part of a Customer Agreement with OutMatch. In these cases, OutMatch acts as a Service Provider, or as a Processor of data, on behalf of our Customer.
- Privacy Shield
OutMatch is responsible for the processing of personal data it receives, under each Privacy Shield Framework, and subsequently transfers to a third party acting as an agent on its behalf. OutMatch complies with the Privacy Shield Principles for all onward transfers of personal data from the EU, UK, and Switzerland, including the onward transfer liability provisions.
With respect to personal data received or transferred pursuant to the Privacy Shield Frameworks, OutMatch is subject to the regulatory enforcement powers of the U.S. Federal Trade Commission. In certain situations, OutMatch may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.
In compliance with the Privacy Shield Principles, OutMatch commits to resolve complaints about our collection or use of your personal information. EU, UK, and Swiss individuals with inquiries or complaints regarding our Privacy Shield policy should first contact OutMatch at email@example.com.
OutMatch commits to cooperate with the panel established by the Data Protection Authorities (DPAs) and/or the Swiss Federal Data Protection and Information Commissioner, as applicable and comply with the advice given by the panel and/or Commissioner, as applicable with regard to human resources data transferred from the EU, UK, and/or Switzerland, as applicable in the context of the employment relationship.
OutMatch has further committed to refer unresolved Privacy Shield complaints to an alternative dispute resolution provider located in the United States. If you do not receive timely acknowledgment of your complaint from us, or if we have not addressed your complaint to your satisfaction, you may visit https://www.jamsadr.com/eu-us-privacy-shield for more information or to file a complaint (free of charge).
Under certain conditions, Privacy Shield provides the right to invoke binding arbitration when other dispute resolution procedures have not provided resolution. This is described in Annex I to the Privacy Shield.
- What Purpose Does OutMatch Have in Collecting Personal Information?
OutMatch collects and processes personal information on the Platform for the purpose of fulfilling our Customer Agreements. OutMatch processes Customer Data under the direction of its Customers and has no direct relationship, control or ownership of the personal data it processes under the Agreement. Customers are responsible for complying with any regulations or laws that require providing notice, disclosure, and/or having a legal basis prior to transferring the data to OutMatch for processing purposes.
OutMatch may access Customer Data for the purposes of providing and enhancing the Platform, preventing or addressing service or technical problems, responding to support issues, and responding to Customer’s instructions, or as may be required by law, in accordance with the relevant Agreement between Customer and OutMatch.
Related to our Customer contacts, OutMatch may use personal information previously provided while using our Platform, upon return on subsequent visits, for greater convenience and in order to avoid having to provide the same information repeatedly, which includes potentially re-using information related to a prior recruiting, development, or performance management process for a new process (for example, the ability to re-use assessment answers for career matching to jobs for Customers).
- What Personal Information Does OutMatch Collect Through its Platform?
In the normal course of using the OutMatch Platform, Customers and their end users (including but not limited to candidates, references, and employees) will input electronic data into the OutMatch systems (“Customer Data”). The use of information collected through our services shall be limited to the purpose of providing the services under the terms of the Customer Agreement. If you are using the Platform as part of a Customer Agreement, the Customer’s privacy practices govern your use and the controls placed on your personal information. Please contact the Customer directly if you would like to obtain information on their privacy practices.
In the course of using the Platform, OutMatch may collect and process the following personal data, or use the following technologies to fulfill our Customer Agreement:
- Information directly provided by you, including personally identifiable information
- Information about you provided from outside sources authorized by the Customer
- Cookies and other browser-based storage, or web beacons necessary for the use of the Platform or to improve and optimize the experience
- Automatically collected information such as usage logging data to secure and support our applications
- Does OutMatch Share or Disclose Personal Information?
If OutMatch receives your information solely in context of fulfilling an Agreement with one or more of our Customers, we will not use or disclose your information except as defined under the terms of the Customer Agreement. In these circumstances, OutMatch’s Customer remains primarily responsible for your information. As a result, we will re-direct a query about our use of your information to our Customer for response. Under the terms of our Customer Agreements and this privacy statement, OutMatch may transfer personal data to our affiliates, subsidiaries, service providers or sub-processors who help us provide our services.
If OutMatch is involved in a merger, acquisition, or sale of all or a portion of its assets that involves Customer Data, prominent notice will be placed on the OutMatch web site, and personal information may be transferred to involved parties.
OutMatch will refer any request for disclosure of personal data by a law enforcement authority to the Customer. OutMatch may, where it concludes that it is legally obligated to do so, disclose personal data to law enforcement or other government authorities. OutMatch will notify the Customer of such request, unless prohibited by law.
OutMatch treats all Client’s Customer Data as confidential and safeguarded, using industry-best security practices to prevent unlawful disclosure.
- International Transfer and Storage of Information
Your information may be transmitted to, collected, stored and processed in the United States or any other country where OutMatch, its affiliates, subsidiaries, or third-party service providers maintain facilities and is agreed upon with the Customer. By submitting your information to OutMatch, you acknowledge and agree to this transmission, collection, storage, and processing, including the potential international transfer of this information. We follow applicable data protection laws when transferring personal information.
- Retention of Information
OutMatch retains Customer Data according to the timeframes set forth in the relevant agreement with its Customers.
- How Does OutMatch Handle the Security of Personal Data?
The security of Customer Data, including personal data, is very important to Outmatch. We maintain an information security program and protect personal information using industry-standard, commercially reasonable physical and technical mechanisms, as well as operational and administrative practices to secure all information from unauthorized access, use, and disclosure. Data is stored in data centers with physical access controls, monitored by security personnel, and restricted to authorized personnel only. All data is encrypted using industry standard protocols as it travels over the internet (for example from your computer or phone to our servers). Of course, no method of transmission or storage is completely secure, therefore we cannot guarantee its absolute security.
- Children’s Privacy
We do not knowingly or specifically collect personal information from users under 16 years of age. We do not authorize users under 16 years of age to use the Site(s) or Platform Services.
- Personal Information Access and Choices
You have certain rights relating to your personal information, subject to local data protection laws.
An individual who seeks access, or who seeks to correct, amend, or delete personal data, should direct their query to the OutMatch Customer (the data controller or business entity directly collecting the information). Individuals inquiring about their rights, or how such Customer Data is collected and processed should refer to the Customer’s own privacy statement and/or contact their privacy officers. If contacted directly by an individual to exercise rights related to Customer Data, OutMatch will refer that individual to the Customer to process the request. If the Customer requests OutMatch to assist them in exercising your rights regarding your personal data to comply with data protection regulations, OutMatch will respond to their request within 30 days.

We may update this statement at any time by posting a revised version on OutMatch site(s). The revised version will be effective at the time of its posting. We encourage you to periodically review this page for the latest information on our privacy practices.
